1. Acceptance of Terms

By accessing or using the ArriveReady website (www.officialarriveready.com) or by purchasing any services from ArriveReady, LLC (“ArriveReady,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions, our Privacy Policy, and all other policies referenced herein. If you do not agree to these terms, you may not access or use our services.

2. Description of Services

ArriveReady provides a concierge stocking service for short-term rental properties (such as Airbnb and VRBO) located in Auburn, Alabama and beyond. Our service involves a trained ArriveReady “stocker” picking up a pre-ordered grocery order from Publix or Walmart and delivering it to your designated rental property. The stocker will then enter the property using access instructions provided by the property manager and fully stock the home: groceries will be put away neatly in the refrigerator, freezer, and pantry, items will be organized intentionally, and light staging will be performed. This is a white-glove stocking service, not a drop-off delivery.

Limitations of Service

  • ArriveReady does NOT shop for or select groceries. Customers are responsible for placing their grocery order directly with Publix/Walmart under their own name.
  • Publix/Walmart employees are responsible for picking and preparing the grocery order. ArriveReady is not affiliated with Publix/Walmart and is not responsible for the accuracy, quality, freshness, substitutions, or retailer delays related to your grocery order.
  • Grocery costs are paid by the customer directly to Publix/Walmart and are separate from any ArriveReady fees.

3. Customer Responsibilities

As a customer of ArriveReady, you agree to:

  • Provide an accurate property address for the rental property where services are to be performed.
  • Provide your correct check-in date for the rental property.
  • Provide valid Publix order confirmation details and the designated pickup window for your grocery order.
  • Provide any special instructions relevant to the stocking service.

4. Property Access and Conduct

ArriveReady stockers will enter the designated rental property solely for the purpose of performing the requested stocking services. Our stockers are trained to respect your privacy and the property. In the event that a stocker is unable to gain access to the property using the provided instructions, ArriveReady will attempt to contact the respective property manager. If access cannot be secured, the service may be canceled, and applicable fees may still apply as outlined in Section 6.

5. Perishables and Food Safety

ArriveReady stockers will exercise reasonable care and promptly refrigerate or freeze perishable items upon stocking the rental property. However, ArriveReady assumes no liability for spoilage or damage to groceries caused by:

  • Retailer handling or preparation (e.g., Publix, Walmart).
  • Appliance malfunction at the rental property.
  • Power outages at the rental property.
  • Delays outside of ArriveReady’s control.

ArriveReady is not responsible for ensuring groceries meet specific allergen requirements or dietary suitability. It is the customer’s responsibility to ensure their grocery order meets their specific needs.

6. Payment, Cancellations, and Refunds

  • Fees: Payment for ArriveReady’s service fees is processed through Stripe. We do not store your credit card details on our servers.
  • Cancellation Policy: Full refund if canceled 24+ hours before pickup, 50% within 24 hours, none once the stocker departs for pickup.
  • Failed Service Due to ArriveReady Error: In the event that ArriveReady fails to complete a confirmed service due to our own error, you will receive a full refund of your order.
  • Failed Access Due to Customer Error: If a service cannot be completed due to customer error (e.g., invalid property address), the following refund policy applies: No refund or partial refund.

7. Promotions and Coupon Codes

  • Promotions and coupon codes are limited to one per customer per order.
  • They cannot be combined with other offers or discounts.
  • Promotions and coupon codes have no cash value.
  • ArriveReady reserves the right to modify or cancel any promotion or coupon code at any time without prior notice.
  • Fraudulent redemption of promotions or coupon codes may result in refusal of service.

8. Damage Claims

Any suspected damage to the rental property caused by an ArriveReady stocker must be reported by the customer within 48 hours of service completion, accompanied by photographic evidence. All claims will be reviewed by ArriveReady in good faith.

9. Acceptable Use of the Website

You agree not to use the ArriveReady website for any unlawful purpose or in any way that could damage, disable, overburden, or impair the website. Prohibited activities include, but are not limited to:

  • Engaging in any form of scraping, data mining, or automated data collection.
  • Attempting to gain unauthorized access to any part of the website or its systems.
  • Impersonating any person or entity.
  • Transmitting any viruses, worms, or other malicious code.
  • Interfering with the proper working of the website.
  • Using the website to commit fraud or engage in any illegal activity.

10. Intellectual Property

The ArriveReady name, logo, website content, and all related intellectual property are the exclusive property of ArriveReady, LLC. You may not use, reproduce, distribute, or create derivative works from any of our intellectual property without our express written permission.

11. Disclaimers and Limitation of Liability

  • “As Is” Basis: All services provided by ArriveReady are offered on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. ArriveReady disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Limitation of Liability: To the fullest extent permitted by applicable law, ArriveReady’s total liability to you for any and all claims arising out of or relating to these Terms and Conditions or the services provided shall not exceed the amount paid by you to ArriveReady for the specific service at issue.
  • Exclusion of Damages: ArriveReady shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Indemnification

You agree to indemnify, defend, and hold harmless ArriveReady, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from:

  • Your breach of these Terms and Conditions.
  • Your provision of inaccurate property information.
  • Your violation of any rights of a third party.
  • Your use of the ArriveReady services.

13. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms or the services shall be governed by the laws of the State of Alabama, without regard to its conflict-of-law principles.

Before filing any formal legal action, you agree to first contact ArriveReady at hello@officialarriveready.com with a written description of the dispute and give us thirty (30) days to attempt to resolve it informally.

If the dispute is not resolved informally, it shall be brought exclusively in the state or federal courts located in Lee County, Alabama, and each party consents to the personal jurisdiction and venue of those courts. Notwithstanding the foregoing, either party may pursue a qualifying claim in small claims court.

15. Changes to Terms

ArriveReady reserves the right to modify or update these Terms and Conditions at any time. We will notify you of any changes by posting the updated Terms and Conditions on our website with a revised “Last Updated” date. Your continued use of the ArriveReady website or services after any such changes constitutes your acceptance of the new Terms and Conditions.

16. Termination / Right to Refuse Service

ArriveReady reserves the right to terminate or suspend your access to our services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions. We also reserve the right to refuse service to anyone for any reason at any time.

17. Severability and Entire Agreement

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect and enforceable. These Terms and Conditions, together with our Privacy Policy and any other legal notices published by ArriveReady on the website, constitute the entire agreement between you and ArriveReady regarding our services.
